DV BRANDS LOYALTY REWARDS PROGRAM TERMS OF USE 

Effective Date: June 1, 2026

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE DV BRANDS LOYALTY REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT ACCESS OR PARTICIPATE IN THE DV BRANDS LOYALTY REWARDS PROGRAM.

These Terms of Use include an arbitration provision that governs any disputes between you and us. Unless you opt out as described in the arbitration provision below, this provision will:

• eliminate your right to a trial by jury; and
• substantially affect your rights, including preventing you from bringing, joining or participating in class or consolidated proceedings. 

You agree that we may provide notices, disclosures and amendments to these Terms of Use, and other information relating to the DV Brands Loyalty Rewards program by electronic means, including posting such information and materials online at www.dvbrands.com.

These Terms of Use apply to your access to, and participation in, the DV Brands Loyalty Rewards program in the United States ("DV Brands Rewards"), which is operated by DV Brands Corporation or its respective subsidiaries, licensees and affiliated companies (collectively, "DV Brands"). These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with DV Brands for other products or services. DV Brands reserves the right to change or modify these Terms of Use or any policy, FAQ, or guideline pertaining to Daddy's Vapor Rewards, in whole or in part, at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to www.dvbrands.com, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued access to or participation in DV Brands Rewards following any such changes or modifications confirms your acceptance of these Terms of Use and such changes or modifications; therefore, you should review these Terms of Use and the policies, FAQs and guidelines pertaining to DV Brands Rewards frequently to understand the terms and conditions that apply to your access to and participation in DV Brands Rewards. If you do not agree to these Terms of Use, you must stop accessing and participating in DV Brands Rewards. 

DV Brands Loyalty Rewards is intended for personal use only. Commercial use is prohibited. DV Brands Rewards is not targeted towards, nor intended for use by, anyone under the age of 21.

About DV Brands Loyalty Rewards

DV Brands Rewards is one way in which DV Brands endeavors to reward and thank loyal customers for patronizing our business and purchasing products featured on www.dvbrands.com. DV Brands Rewards members are able to earn and accumulate "Points" that can be redeemed for DV Brands Rewards benefits on www.dvbrands.com.

DV Brands Rewards Eligibility

To be eligible to join DV Brands Loyalty Rewards in accordance with these Terms of Use, you must create an account on www.dvbrands.com with a valid email address and be a U.S. resident since the rewards program is available to U.S. residents only. 

You must also be at least 21 years of age and be able to provide proof of age when acquiring points or redeeming points for rewards. Otherwise, you will be ineligible to participate in the DV Brands Rewards program. 

The DV Brands Rewards program is intended solely for individual end consumers purchasing products for personal use. The following parties are ineligible to participate in the Program and may not earn, accumulate, or redeem rewards:

• Retail stores, shops, boutiques, and any other retail establishments, whether brick-and-mortar or online;
• Wholesale distributors, brokers, jobbers, and any entity purchasing products for resale or redistribution;
• Employees, officers, directors, contractors, and agents of any retail store, wholesale distributor, or other trade or commercial entity, when purchasing in connection with their employment or business activities;
• Any individual or entity purchasing products for commercial, business, or resale purposes.

Participation in the Program is limited to individual consumers purchasing products exclusively for personal, non-commercial use. DV Brands reserves the right to disqualify any participant and void any rewards if, in its sole discretion, it determines that a participant does not meet the eligibility requirements set forth herein.

Earning Points

The rewards that are available to you through DV Brands Rewards are based on the number of points that you earn. You can earn points for purchases, creating an account, referrals, your birthday, following our Instagram, and signing up for our mailing list. Points are added immediately after completing a point rewarding action. The quantity of points awarded for the above actions are as follows:

• 1 Point - Per bottle on every receipt uploaded to your account that feature a DV Brands eliquid bottle including  Twist, Cloud Nurdz, Sadboy, Mrkt Plce, I Love Salts, Mints, Zen Haus, Innevape, and bad drip.
• 1 Point - Per Fumi x Cloud Nurdz 55K Disposable or Pouch Nurdz pouch every receipt uploaded to your account.

You will earn points based on proof of purchase receipt. Each receipt uploaded must include at least one of the brands featured above. 

Point Redemption*

As a member of DV Brands Rewards, you are eligible to redeem promotional merchandise from DV Brands. Please note, points cannot be redeemed until 14 days after they are rewarded. The point redemption tiers for redeeming points are as follows:

• 250 Points - One (1) Branded Tote Bag, Extendable Pointer, or Clear Bag
• 500 Points - One (1) Water Bottle, Hat, Shirt, or $25 Gift Card to Starbucks, DoorDash or Dunkin Donuts 
• 2,500 Points - One (1) Beats Powerbeats Fit, Apple Airpods 4, or Bose QuietComfort Earbuds, or $100 Gift Card to Ulta, Amazon or Uber
• 5,000 Points - One (1) Yeti Cooler, Samsung Galaxy Tablet, or Apple iPad 11 A16
• 10,000 Points - One (1) Meta Quest 3, Meta Ray Ban Glasses, or Apple Watch 11 Series

Other Important Information You Should Know 

These Terms of Use complement and incorporate by reference the DV Brands Terms of Use. In the event of any conflict between the DV Brands Card Terms and Conditions and these Terms of Use, the DV Brands Card Terms and Conditions control.

DV Brands is not responsible for receipts which are not scannable. Points are not guaranteed with every receipt upload.

There are no participation or membership fees associated with DV Brands Rewards. Points accrued in connection with DV Brands Rewards are promotional. In addition, your redemption of points accrued in connection with DV Brands Rewards cannot be combined with any other offers or discounts that are applicable to the Rewards for which you are redeeming such points, unless otherwise expressly indicated by DV Brands.

Without notice to you, DV Brands  also reserves the right to "unregister" and make ineligible any DV Brands Rewards account that has been inactive for two (2) consecutive years. Inactivity is defined as no points earned during such two (2) consecutive year periods. In the event that your DV Brands Rewards account is unregistered or rendered inactive, all accrued points in your DV Brands Rewards account are void. DV Brands will also "unregister" accounts deemed fraudulent or abusing the points system.

DV Brands reserves the right to change, modify, discontinue or cancel DV Brands  Rewards or any part of DV Brands Rewards, at any time and in its sole discretion, without notice to you. Please note, points cannot be redeemed until 14 days after they are rewarded.
