Participation Limited to Eligible Smokers 21 Years Of Age Or Older Who Are Legal Residents Of The 50 United States Or The District of Columbia (Excluding Residents Of MA and MI) And Who Submit a Request in the Perfect Combo Scratch Off Program.

1.  Eligibility: The Perfect Combo Scratch Off Sweepstakes (the “Sweepstakes”) is open only to smokers twenty-one (21) years of age or older at the time of entry, who are legal residents of the fifty (50) United States (excluding Massachusetts and Michigan) and the District of Columbia (“Eligible Entrants” or “Entrants”). Employees, officers, and directors of DV Brands, Inc. (the “Presenter”), or any of their respective parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, (the “Administrator”) (collectively, the “Sweepstakes Entities”), and members of their immediate families (spouses, parents, siblings, and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Noncompliance with any of the above eligibility requirements will result in disqualification. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void in Massachusetts, Michigan and where prohibited. Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to these Official Rules and Presenter’s and Administrator's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Sweepstakes begins on March 21, 2024, at 9:00:00 a.m. Pacific Standard Time (“PT”), ends on August 30, 2024, at 11:59:59 p.m. PT (the "Promotion Period") and consists of two (2) entry periods which coincides with the Promotion Period.

Administrator’s computer is the official timekeeping device for the Sweepstakes.

4. How to Enter: To enter the Sweepstakes, you must first register your information at https://www.dvbrands.com. After creating a DV Brands account, access https://www.dvbrands.com/uwellsweeps/ and click on the link titled “Uwell Scratch Off Sweepstakes”. Follow the instructions to either provide the scratch off code located on specially marked product packages of select Uwell x DV Brands products to receive one (1) Sweepstakes entry per unique product code, per day, for the Sweepstakes Entry Period. 

Alternative Method Entry: You may also enter the Sweepstakes by emailing Sponsor at sweeps@dvbrands.com during the Entry Period, including the name of the Sweepstakes for which you are entering, your Email Address, First Name, Last Name, Home Address (no P.O. Boxes), date of birth, and Phone Number (including area code) (collectively, “Entry Information”). Limit of one (1) Entry per day during each Entry Period.  Entries that are not in compliance with the Official Rules may be disqualified at Sponsor’s discretion. An emailed entry is “received” when the Sponsor’s servers record the entry information.

By registering and creating an account on https://www.dvbrands.com, entering into the Sweepstakes through the DV Brands website, or by entering the Sweepstakes by email: you expressly authorize DV Brands to retain your identifying information for marketing purposes, enroll in the DV Brands mailing list, and consent to receive marketing and promotional material from DV Brands and its authorized affiliates.

Limit: Each Entrant can receive one (1) Sweepstakes entry per calendar day during the Promotion Period. A “day” is defined as a 24-hour period between 12:00:00 a.m. PT and 11:59:59 p.m. PST, except the first day which begins at 9:00:00 a.m. PST and ends at 11:59:59 p.m. PST.

Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the account used to register will be deemed to be the entrant. The potential winners may be required to show to the Presenter and Administrator proof of being the authorized account holder for the winning prize or forfeit the prize. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply.

Multiple entrants are not permitted to share the same email address. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant. The “entrant” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder to the Sponsor or forfeit the prize. Entries specifying an invalid, non-working, or inactive email address, will be disqualified and ineligible to win. You must complete all required information to be eligible to enter. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified.

5. Prizes:

Total ARV of all prizes to be awarded: $50,000.00.

Income tax liability is the responsibility of the participant.

For All Prizes: The actual value of prizes may be subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Winners will not be entitled to the difference between actual value and ARV of the prize awarded. Prizes cannot be substituted, assigned, transferred, or redeemed for cash; no substitution or cash redemption will be made, except Presenter reserves the right to substitute a prize or a component thereof for one of equal or greater value if the designated prize should become unavailable for any reason. Presenter will not replace any lost or stolen prizes or components of prizes. Prizes cannot be used in conjunction with any other promotion or offer. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of the winner. Only the number of prizes stated in these Official Rules are available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Limit: One (1) Monthly Prize per month per person and one (1) Grand Prize per person throughout the Promotion Period.

Each winner acknowledges that the Released Parties (as defined below) have not made, nor are in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, merchantability, or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.

6. Prize Drawings: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes, the selection of the potential winners, and all matters related to the Sweepstakes are final and binding. The odds of winning are based on the number of eligible entries received for each applicable Entry Period. On or about the dates listed above in Section 3, Table 1, Administrator will randomly select the winners from all eligible entries received during the applicable Entry Period. The potential winners will be notified by email. Each Grand Prize potential winner will be required to sign and return a Declaration of Compliance, Liability and Publicity Release (“Declaration”), which must be received by the Administrator within seven (7) days of the date notice or attempted notice is sent, in order to claim their prize. If a potential winner cannot be contacted, fails to sign and return the Declaration (if applicable) or provide any requested information within the required time period (if applicable), prize is returned as undeliverable, or prize is undelivered or not received by potential winner due to missing information (including, but not limited to, a valid address and valid phone number), potential winner will forfeit his/her prize. Entrants are responsible for keeping their contact information associated with the administrator current. Presenter is not responsible for any change in email or mailing address. In the event that a potential winner is disqualified and/or forfeits his/her prize for any reason, Presenter will award the applicable prize to an alternate winner by random drawing from among all remaining eligible Sweepstakes entries for the applicable Entry Period. If Presenter and Administrator are unable to determine and verify a potential winner after repeated alternate drawings or if Presenter and Administrator fail to receive a sufficient number of entries to correspond to the number of prizes available to be awarded, Presenter and Administrator reserve the right to not award all prizes. Only five (5) alternate drawings will be held, after which the prize will remain unawarded. Unclaimed prizes valued at or less than $25 will not be awarded. Prizes will be fulfilled approximately 8-10 weeks after winner verification.

Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY PRESENTER, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

7. Release: BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT PRESENTER, ADMINISTRATOR, AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANT AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, EPIDEMICS, WIDESPREAD ILLNESS, WEATHER, OR TERRORISM. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE.

8. Publicity: EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES WINNER’S GRANT TO PRESENTER (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF PRESENTER) AND THE RELEASED PARTIES, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE WINNER’S ENTRY, NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING BUT NOT LIMITED TO HOMETOWN AND STATE) FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES WITHOUT FURTHER PAYMENT, CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.

9. General Conditions: Presenter reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Presenter in its sole discretion. If, for any reason, the Sweepstakes cannot be run as planned, Presenter may (a) suspend the Sweepstakes and modify the Sweepstakes to address the impairment, then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (b) award the prize(s) at random from among the eligible, non-suspect entries received up to the time of the impairment. Presenter reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the website, or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, PRESENTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Presenter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending or submission of an entry will not be deemed proof of receipt by the Presenter and Administrator.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an Entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Presenter reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

11. Disputes: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Central District of California or an appropriate California State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Presenter in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

12. Entrant's Personal Information: Information collected from Entrants is subject to the Presenter’s Privacy Policy (https://www.dvbrands.com). If you are chosen as a winner, your information may be included in a publicly available winner list and/or used in a manner consistent with the provisions within these Official Rules.
